The protection of residential property rights - tenants and owners do not always agree

Even in Saxony, there is not always agreement between landlords and tenants. Disputes often arise over the service charge bill or an intended rent increase.

And then there are also possible damages within the apartment: mold, for example, or other defects. Who actually has to pay for this and when? Or if property disputes arise under building law? Both tenants and owners of owner-occupied apartments should protect themselves for all these and many other similar cases. Otherwise, enforcing your rights can be really expensive.

Why good home legal protection insurance is so important

Tenants want to feel safe, comfortable and secure within their own four walls. The same applies to homeowners who use their property themselves. However, if at some point - for example for the reasons mentioned above - a legal dispute, the financial risk is high. After all, no one can know beforehand how the whole thing will turn out. To ensure that the dispute does not end in a financial fiasco, there is legal expenses insurance for residential property. It is a special variant of classic legal expenses insurance and protects tenants and owners against all legal problems that are explicitly related to the property or living space. In the event of a case, it not only covers legal fees and court costs, but also the often extremely high costs of an expert. However, it does not cover other disputes that have nothing to do with housing.

The cost of home legal protection insurance

Residential legal protection insurance are are generally quite inexpensive and can usually be taken out for a manageable monthly fee. The exact conditions depend on the respective provider and the desired modules. In addition to home legal protection insurance, you may also want to insure the area of transportation and/or work, as legal disputes are also on the rise in these areas.

What is not covered by home legal protection insurance?

Additional homeowners' or household contents insurance is nevertheless advisable in many cases, as homeowners' legal protection insurance does not cover the values and items in the building or within a home. It only covers legal disputes relating to the tenancy or home ownership.

Benefits of home legal protection insurance

If possible, the sum insured should be unlimited: This is a matter of course for many insurers. In addition, the insurance must cover all the examples mentioned above and, if possible, also problems with municipal water or waste charges. However, whether other owner-occupied properties are also insured depends on the insurance provider selected and the exact terms of the policy. The same applies to the co-insurance of close relatives such as parents and grandparents. This usually requires a so-called family contract: then, for example, the children's student accommodation could also be insured. As a rule, a waiting period applies for some types of legal protection insurance. However, benefits such as legal advice by telephone are almost always available to policyholders immediately and without a waiting period.

Whether it's constantly emerging defects in an old building or recurring disputes with the landlord in an area with an already tight housing market, appropriate insurance cover takes a considerable burden off the shoulders of many tenants and owners. At a time when the housing shortage is an omnipresent issue, it is therefore becoming increasingly important.
